Property conveyancing is a generally misunderstood area of law. The perception is that it is simply an administrative process and that it is a good idea to instruct the cheapest lawyers to do the job.
Unfortunately, as with many things in life, cheap can end up costing dear. In reality there are 3 aspects to conveyancing, all of which are important :-
- EFFICIENCY -That the conveyancers are organised and proactive – it is little known that most conveyancing transactions involve around 20 separate processes before exchange of contracts and a lot of correspondence and phonecalls
- COMMERCIALITY – That the conveyancers are experienced in dealing with lenders – lenders are an important part of the process and the experience and attitude of the conveyance, in dealing with the buyer’s lenders, is important
- LEGAL KNOWLEDGE & EXPERIENCE - That the conveyancers know the law and check the property tile, any lease, searches and paperwork thoroughly. This is taken for granted, understandably, by a client, but may not happen in reality with a cut price service, or may be done by unqualified or inexperienced staff – do you really want to take that risk ?
Summary of conveyancing
In a nutshell the conveyancing process is designed to :-
- Confirm that sellers actually owns the property
- Confirm the identities of the parties
- What are the legal and financial charges recorded against the property and satisfactory confirmation they will be removed on completion
- Appropriate non-standard enquiries are raised and dealt with by the sellers
- There are no risks or adverse records about the property from the searches at the local authority, local water or utilities
- With leases, that the lease is satisfactory, has not been breached and that the Freeholder or Management companies work properly and efficiently
- Monies are correctly calculated, received and dealt with
- Mortgages or charges are paid off on completion and the buyer’s mortgage paperwork is properly in place
- The property gets registered at the Land registry and any stamp duty is paid
