Commercial lawyers need to have an understanding of “real world” issues in addition to an understanding of complex technical legal issues. In our experience, clients instructing a solicitor for a business matter, whether transactional or, for example, in dealing with an employment law problem, will want that solicitor to have an appreciation of commercial realities and that spending money on legal work is generally a cost/benefit exercise for clients.
In aproaching these types of instructions, we find that the best approach is often to place ourselves in the role of the client and to ask ourselves whether we would incur costs or not, sizing up all aspects of the matter, not just the legal considerations.
